Terms and Conditions

Introduction

Vaujany Ski Company ("the Company") operates as an agency to provide a service where Guests can view listings of, and obtain information about, properties offered for rent (“Properties”) by property Owners (each, an “Owner” and collectively with a Guest, the “users”). We offer a service to allow users to communicate with each other and to enter into rental agreements or other transactions with each other.

Vaujany Ski Company is not, and does not become, a party to any contractual relationship between the Guest and the Owner, and does not mediate between the Guest and the Owner in the event of any dispute arising between them. This is true even if the Company facilitates a booking for a Property as the Company is not a party to any rental or other agreement between Guest and Owners.

1. Basis of Contract

The Company shall create a Property Booking Form between the Owner and the Guest to reflect the nature of the rental. The submission of the Property Booking Form constitutes an offer by Guest to let the Property from Vaujany Ski Company Ltd in accordance with these Terms and Conditions and the Property Booking Form. The booking shall only be deemed accepted upon receipt of the deposit and written acceptance of the booking by us and on which date a contract shall come into existence (the “Contract”).

This Contract is made for the purpose of a holiday and will be an agreement between the Guest and the Owner.

2. Payment

A booking deposit as set out in the booking form is payable if the booking is made more than two months before the date the Holiday Period commences (“Commencement Date”).  The balance of the Booking Price is payable two months before Commencement Date.  Non-payment of the balance of the Booking Price on or before the due date shall be construed as a cancellation of the Contract by you.  For bookings made less than two months before the Commencement Date, the Booking Price is payable on submission of the booking form.  

3. Damage Deposit

The amount of Damage Deposit is set out in the Property Booking Form. The Guest is required to comply with the obligations detailed in paragraphs 10 and 11 below during the holiday period.  We will deduct from the Damage Deposit the cost of remedying any breach of these obligations together with the cost of any service or goods provided. The balance of the Damage Deposit will be refunded to the Guest promptly following the end of the Holiday Period.  Vaujany Ski Company does not mediate between the Guest and the Owner in the event of any dispute arising between them. 

4. Cancellation

Any cancellation made by the Guest for whatever reason shall be in writing and addressed to Vaujany Ski Property Ltd, 1 Downs Cote Avenue, Bristol BS9 3JX.  Cancellation fees are laid out in the Property Booking Form.
We strongly recommend that the Guest takes out Cancellation Insurance.

5. Changes of Date

We may at our discretion agree to change the dates of the Holiday Period upon receipt of a written request from the Guest.  If the dates of the Holiday Period are not changed the booking will remain in place and all monies will remain due.

6. Period of Hire

Check-in and check-out times are set out in the Property Booking Form.

7. Use of Property

The number of persons occupying the Property must not exceed the maximum number stipulated in the Property Booking Form. The types of groups occupying a Property must comply with the Property Booking Form. The Property will be used for personal and domestic purposes only. The property shall not be used for any commercial purposes without our written consent.  We reserve the right to refuse entry to the entire party if these conditions are not observed.

8. Complaints

Should there be any cause for complaint during the occupation of the Property it must be notified promptly to us and in case of serious problems confirmed in writing.

9. Breakages or Damage

In the event of breakages, damage or the need for additional cleaning the Guest shall reimburse the Owner for replacement, repair or extra cleaning costs incurred. These costs will be deducted from the Damage Deposit, but are not limited to that amount. The Guest will be invoiced by the Owner for any costs above the amount of the Damage Deposit.

10. Care of the Property

The Guest shall not cause any damage to the Property including its grounds.  The Guest shall keep the Property and its furnishings, pictures, kitchen equipment and all other fittings and effects in good and clean condition.  The Guest shall be responsible for repairing any damage.

11. Pets

Guests must adhere to the pet policy as set out in the Property Booking Form.

12. No Smoking Policy

All our properties are entirely non-smoking. If evidence of smoking in the Property is found then the entire Damage Deposit will be retained by the Owner.

13. Liability

Vaujany Ski Company shall not be liable to the Guest or third parties for any accident, damage, loss, injury, expense or inconvenience, which may be suffered, incurred, arise out of or in any way connected with the letting.  If the Property becomes unavailable or unusable for some reason prior to the date of a booking, then our obligation will be to (1) use our best endeavor to find a suitable alternative property, or failing which (2) to reimburse the Guest for any monies paid.

14. Warranties

We do not warrant and are not responsible for the accuracy of any verbal information given or statements made by its staff.

15. Website and advertisements

We aim to ensure that the information and descriptions provided are accurately conveyed on the official website and any authorised third-party websites or advertisements. There may be small differences between the actual accommodation and its description as we are always seeking to improve services and facilities.  Occasionally, problems mean that some facilities or services become unavailable, and if this is the case we will tell the Guest as soon as reasonably practical after we have been made aware of the situation. Similarly, we cannot accept responsibility for any changes or closures to local area amenities or attractions mentioned on the website or advertised elsewhere.

16. Right of Entry

We shall be allowed the right of entry to the Property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

17. Children

The Guest must accept responsibility for the safety of their children.

18. Cancellation Insurance

Cancellation Insurance is strongly recommended.

19. Pricing

We reserve the right to change the advertised prices of our properties at any time without prior notification. We will confirm the price of the holiday at the point of booking and the price agreed for the Property (excluding any extras), as specified on the booking form will remain firm and will not be changed under any circumstances.  Prices are inclusive of VAT where applicable.
